CUSTOMER PRIVACY NOTICE REGARDING THE PROCESSING OF PERSONAL DATA pursuant to Article 13 of EU Regulation No. 2016/679 2016/679

SCANDOLA MOBILI S.r.l., with registered office at Via del Lavoro, 7 – 37021 Bosco Chiesanuova (VR), Tax Code and VAT No. 03853100232 (hereinafter referred to as the “Data Controller”), as the controller of data processing, informs you pursuant to Article 13 of EU Regulation No. 2016/679 (hereinafter, “GDPR”) that your data will be processed in the manner and for the purposes as follows:

1. Data Processing Subject
The Data Controller processes personal, identification data (for example, name, surname, company name, address, telephone, email, banking and payment references) – hereinafter, “personal data” or also “data”, which you have provided in the context of concluding contracts for the services of the Data Controller and/or through visiting our website (for example, by registering and/or accessing a reserved area, writing to an email address to request information, or by calling one of our telephone numbers).
The optional, explicit, and voluntary sending of emails to the addresses indicated on this site or the completion of specific data entry forms to receive services/information or make requests, entails the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data entered in the missive. Specific summary information notices and any consent requests, if necessary, will be progressively reported or displayed on the pages of the site set up for particular services on request.

2. Purpose of Processing
The data provided by the User will be processed, without the User’s prior consent pursuant to Article 6 letter b) GDPR, for the following purposes:

a. for the management and processing of statistical surveys on the use of the Site;
b. to carry out maintenance and technical support necessary to ensure the correct functioning of the Site and services connected to it;
c. to improve the quality and structure of the Site, as well as to create new services, functionalities, and/or features of the same;
d. to process any contact requests submitted by the User through the completion of the specific form or by email;
e. to allow the Company to exercise its rights in judicial proceedings and suppress illicit behaviors;
g. to fulfill legal or regulatory obligations.

Your personal data is also processed to be able to use the free Service, provided by Scandola Mobili, of sending – also via email – newsletters and communications with promotional, informative, and/or advertising content related to products or services, including free products, prize events promoted by the same. Providing data marked as mandatory on the registration form is necessary to be able to use the Service, and refusal to provide such data will result in Scandola Mobili being unable to perform the requested Service.

3. Processing Methods
The processing of your personal data is carried out through the operations indicated in Article 4(2) GDPR, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion, and destruction of data. Your personal data is subject to both paper and electronic and/or automated processing.
The Data Controller will process personal data for the time necessary to fulfill the purposes mentioned above and, in any case, the data will be stored beyond the date of termination of the relationship for the fulfillment of the terms provided by law for the retention of administrative documents.
Data for Marketing purposes alone are processed until the withdrawal of consent or for no longer than 2 years from the last interaction.
After the terms mentioned above, the data will be deleted, destroyed, or simply stored in an anonymous form.

4. Website – Redirects to External Sites
The website “scandolamobili.it” may use so-called social plugins. Social plugins are special tools that allow the functionalities of the social network to be incorporated directly within the website (e.g., Facebook’s “like” function):

From the “scandolamobili.it” website, it is possible to link, through special links, to other websites of the Data Controller or it is possible from third-party websites to connect to our website.
The Data Controller declines any responsibility regarding the possible request and/or release of personal data to third-party sites and concerning the management of authentication credentials provided to third parties.

6. Data Access
Your data may be made accessible for the purposes expressed above:

– to employees and collaborators of the Data Controller, in their capacity as persons in charge and/or internal managers of the processing and/or system administrators;
– to third-party companies or other entities (for example, credit institutions, professional firms, consultants, providers for the management and maintenance of the website, etc.) that perform outsourcing activities on behalf of the Data Controller, in their capacity as external managers of the processing.

7. Data Communication
Without the need for express consent (Article 6 letters b) and c) GDPR), the Data Controller may communicate your data for the purposes from a) to g) to Supervisory Bodies, Judicial Authorities, as well as to those subjects to whom communication is mandatory by law for the performance of said purposes. These subjects will process the data in their capacity as independent data controllers.
Your data will not be disseminated.

8. Data Transfer
The management and storage of personal data will take place on servers located within the European Union of the Data Controller and/or third-party companies engaged and duly appointed as Data Processors. The personal data is currently stored on servers located at the company’s headquarters and within the European Union. It is understood, however, that the Data Controller, if necessary, will have the faculty to move servers outside the EU. In such a case, the Data Controller assures from now that the transfer of data outside the EU will take place in accordance with applicable legal provisions, after the signing of the standard contractual clauses provided by the European Commission.

9. Nature of Data Provision and Consequences of Refusal to Respond
The provision of data for the purposes from point a) to g) is mandatory. Without it, we cannot guarantee you the Services listed. The provision of data for communication and marketing purposes, on the other hand, is optional. You can therefore decide not to provide any data or subsequently deny the ability to process data already provided: in this case, you will not receive newsletters, commercial communications, and advertising material related to the Services offered by the Data Controller.

10. Rights of the Data Subject
As a data subject, you have the rights under Article 15 GDPR and specifically:

1. The data subject has the right to obtain from the data controller confirmation as to whether or not personal data concerning him or her are being processed, and, if so, access to the personal data and the following information:

a. the purposes of the processing;
b. the categories of personal data concerned;
c. the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular if recipients of third countries or international organizations;
d. whenever possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
e. the existence of the right to request from the data controller rectification or deletion of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
f. the right to lodge a complaint with a supervisory authority;
g. where the data is not collected from the data subject, any available information as to their source;
h. the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject;

2.Where personal data are transferred to a third country or to an international organization, the data subject has the right to be informed of the existence of adequate safeguards pursuant to Article 46 relating to the transfer.

3. The data controller provides a copy of the personal data undergoing processing. For any further copies requested by the data subject, the data controller may charge a reasonable fee based on administrative costs. If the data subject submits the request by electronic means, and unless otherwise requested by the data subject, the information shall be provided in a commonly used electronic form.

4. The right to obtain a copy referred to in paragraph 3 must not adversely affect the rights and freedoms of others.

Where applicable, you also have the rights under Articles 16-21 GDPR (Right to Rectification, Right to be Forgotten, Right to Restriction of Processing, Right to Data Portability, Right to Object), as well as the right to lodge a complaint with the Supervisory Authority.

You can exercise your rights at any time by sending:
